1. Definitions
1.1 "Promoter" means Mingle Seasoning, ABN 85 610 269 148, of Level 2, 785 Toorak Road, Hawthorn East VIC 3123.
1.2 "Competition" means the Tiny Food Critics competition conducted by the Promoter during the Promotion Period.
1.3 "Promotion Period" means the period commencing at 12:00am AEST on 11 August 2026 and ending at 11:59pm AEST on 24 August 2026.
1.4 "Entrant" means an Australian resident aged 18 years or over who submits a valid entry in accordance with these Terms during the Promotion Period.
1.5 "Nominated Child" means the child identified in an Entry and who is between one (1) and ten (10) years of age at the time the Entry is submitted.
1.6 "Entry Content" means any written content, photograph, video, image, recording or other material submitted to the Competition.
1.7 "Prize" means the Major Prize or a Runner-Up Prize described in clause 7, as applicable.
1.8 "Winner" means an Entrant whose entry is selected as a winning entry in accordance with clause 5.
1.9 "Website" means the Mingle competition landing page at [INSERT URL].
2. Eligibility
2.1 The Competition is open to Australian residents aged eighteen (18) years or older.
2.2 The Entrant must be the parent or legal guardian of the Nominated Child, or otherwise have authority from the parent or legal guardian to submit the entry and any Entry Content featuring the Nominated Child.
2.3 Employees of the Promoter and their immediate family members are not eligible to enter. “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin
2.4 The Promoter reserves the right to verify the eligibility of any Entrant and the age of any Nominated Child and to disqualify any entry that does not meet the eligibility requirements set out in these Terms.
3. How To Enter
3.1 To enter the Competition, an Entrant must, during the Promotion Period:
either:
- (i) submit an entry via the competition landing page located at [INSERT URL]; or
- (ii) publish an entry on Instagram or Facebook using the hashtag #TheTiniestFoodCritic; and
provide:
- (i) a written story nominating the toughest little food critic in their household;
- (ii) a description of the strategies, tools, tricks, habits or approaches that form their dinnertime toolkit; and
- (iii) all information reasonably requested by the Promoter.
3.2 Each qualifying written entry constitutes one (1) entry.
3.3 An Entrant who submits a photograph or video featuring the Nominated Child together with their written entry will receive an additional entry for judging purposes.
3.4 Photographs and videos are optional and are not required to enter the Competition.
3.5 The Nominated Child must be between one (1) and ten (10) years old at the time of entry.
3.6 Entries submitted after the end of the Promotion Period will not be accepted.
3.7 No purchase is necessary to enter the Competition.
3.8 Where an entry is submitted via Instagram or Facebook, the Entrant's account must remain public and capable of receiving direct messages from the Promoter until the Winners have been notified. The Promoter is not responsible for any inability to contact an Entrant due to privacy settings or account restrictions.
4. Entry Requirements & Conditions
4.1 All entries must be the original work of the Entrant. Entries must not:
- infringe the intellectual property rights of any third party;
- contain material that is defamatory, offensive, obscene, discriminatory or otherwise inappropriate;
- contain any false, misleading or deceptive statements; or
- breach any individual’s right to privacy or any obligations of confidentiality.
4.2 The Promoter reserves the right to reject or disqualify any entry that does not comply with these Terms or that the Promoter considers, in its sole discretion, to be inappropriate, offensive or not in keeping with the spirit of the Competition.
4.3 By submitting an entry, the Entrant warrants that:
- the entry is their own original work;
- all Entry Content is owned by the Entrant or submitted with the consent of the relevant rights holder;
- where any photograph or video depicts a child, the Entrant is the child's parent or legal guardian or has obtained all necessary parental or guardian consents;
- the Entrant has the right to grant the licence in clause 9;
- any photograph or video submitted as part of the Entry was lawfully taken and submitted and does not infringe the privacy or other rights of any person;
- where any person other than the Nominated Child is identifiable in any Entry Content, the Entrant has obtained all necessary permissions for their inclusion in the Entry Content and for the uses contemplated by these Terms; and
- all information supplied is true and accurate.
4.4 The Entrant warrants that their entry complies with the requirements of clause 4.1, and indemnifies the Promoter, its officers, employees, contractors and agents against any loss, damage or cost arising from any claim arising from an alleged contravention of the requirements of clause 4.1 or the warranties in clause 4.3.
4.5 Entry Content must not depict any child in a manner that is unsafe, exploitative, inappropriate or likely to bring the child into disrepute or ridicule.
5. Judging
5.1 This Competition is a game of skill. Chance plays no part in determining the winners.
5.2 All eligible entries received during the Promotion Period will be judged by the Mingle marketing team (the "Judging Panel") on the following criteria:
- Creativity;
- Originality; and
- Quality and effectiveness of storytelling.
5.3 The Judging Panel will select one (1) Major Prize Winner and two (2) Runner-Up Winners based on the entries that best demonstrate the above criteria in their sole and absolute discretion.
5.4 Judging will take place from 25 August 2026. The Promoter reserves the right to extend the judging period if required.
5.5 The decision of the Judging Panel is final and binding. No correspondence will be entered into regarding judging decisions.
6. Winner Notification
6.1 Winners will be notified by email and/or telephone on or about 31 August 2026.
6.2 If a Winner cannot be reached by telephone, the Promoter will contact them by email using the address provided at the time of entry, or by direct message through Instagram or Facebook where the entry was submitted pursuant to clause 3.1(ii).
6.3 A Winner must respond to the Promoter's notification and confirm their acceptance of the Prize within seven (7) days of being notified ("Claim Period").
6.4 If a Winner does not respond and claim their Prize within the Claim Period, the Prize will be forfeited and the Promoter reserves the right to award the Prize to the next highest-ranked eligible entry, at the Promoter's sole discretion.
6.5 Winners will be announced on the Promoter's website and social media channels. By entering, Entrants consent to this announcement.
7. The Prize
7.1 There is one (1) Major Prize comprising AUD $3,000.
7.2 The Major Prize is intended to support a kid-free weekend away for the winning parent or parents. The winner may use the prize at their discretion.
7.3 There are two (2) Runner-Up Prizes, each consisting of a year's supply of Mingle products valued at AUD $500.
7.4 The total prize pool is valued at AUD $4,000.
7.5 Prizes are not transferable, exchangeable or redeemable for cash, except where the major prize is awarded in cash or by electronic funds transfer at the Promoter's discretion.
7.6 If a Prize (or component of a Prize) becomes unavailable for any reason, the Promoter reserves the right to substitute an alternative prize of equal or greater value.
7.7 The Promoter accepts no responsibility for any tax liability arising from receipt of a Prize. Entrants should seek independent financial advice if required.
8. Privacy & Data Collection
8.1 By entering the Competition, Entrants consent to the Promoter collecting, storing, using and disclosing their personal information for the purposes of:
- administering and conducting the Competition;
- contacting Entrants in relation to their entry and, if applicable, their Prize;
- announcing Winners; and
- sending marketing communications from the Promoter, where consent has been provided.
8.2 The Promoter will handle all personal information in accordance with its Privacy Policy, available at https://www.mingleseasoning.com/pages/custom-privacy-terms, and the Privacy Act 1988 (Cth).
8.3 Entrants may opt out of receiving marketing communications at any time by contacting the Promoter at jordyn@mingleseasoning.com or by following the unsubscribe link in any marketing communication.
8.4 The Promoter will not sell or disclose personal information to third parties except as required for the administration of this Competition or as required by law.
8.5 Entrants acknowledge that personal information relating to children included in entries will be collected solely for the administration of this Competition and for the purposes permitted under clause 9.
9. Intellectual Property & Content Rights
9.1 Entrants retain ownership of all intellectual property rights in their Entry Content.
9.2 By submitting an entry, the Entrant grants the Promoter a non-exclusive, royalty-free, worldwide licence to reproduce, publish, communicate and display the Entry Content solely for:
- administering the Competition;
- promoting, publicising and reporting on the Tiny Food Critics campaign;
- publication on the Promoter's website and social media channels; and
- publicity and public relations activity relating to the Tiny Food Critics campaign.
9.3 The licence granted under clause 9.2 commences upon submission of the entry and expires two (2) months after the Competition close date.
9.4 Following expiry of the licence period in clause 9.3, the Promoter must not make any new use of the Entry Content for marketing, advertising, publicity or promotional purposes.
9.5 For the avoidance of doubt, expiry of the licence granted under clause 9.2 does not require the Promoter to remove, recall or delete historical publications made during the licence period, including social media posts, website content, media articles or press coverage created in connection with the Competition. Any such material may remain publicly available in its existing form, provided the Promoter does not make any new use of the Entry Content after the licence period expires.
9.6 The Entrant warrants that their entry does not infringe the intellectual property rights or any other rights of any third party, and indemnifies the Promoter, its officers, employees, contractors and agents, against any loss, damage or cost arising from any claim of such infringement.
9.7 The Promoter will use reasonable endeavours to attribute Entry Content to the relevant Entrant when using Entry Content in promotional materials, but is not obliged to do so.
10. Publicity & Consent
10.1 By entering the Competition, each Entrant consents to the Promoter publishing their first name, suburb/location and Entry Content for the purposes described in clause 9, including in media releases, social media posts, and on the Promoter's website, without further notice or compensation.
10.2 Where an entry includes a photograph or video featuring a child, the Entrant confirms that all necessary parental or guardian consents have been obtained for the use permitted under these Terms.
10.3 The Promoter may invite a Winner to participate in reasonable publicity relating to the Competition. Participation is voluntary and refusal to participate will not affect the Winner's entitlement to receive the Prize.
11. General Conditions
11.1 By entering the Competition, Entrants agree to be bound by these Terms and Conditions.
11.2 The Promoter reserves the right to verify the eligibility of Entrants and the Nominated Child and to disqualify any Entrant who:
- provides false or misleading information;
- tampers with or attempts to tamper with the Competition entry process;
- engages in conduct that is dishonest, fraudulent or otherwise contrary to these Terms; or
- acts in a way that the Promoter considers, in its sole discretion, to be inappropriate or contrary to the spirit of the Competition.
11.3 If for any reason this Competition is not capable of running as planned (including due to infection by computer virus, network failure, bugs, tampering, fraud, technical failures or any cause beyond the Promoter's reasonable control), the Promoter reserves the right to cancel, terminate, modify or suspend the Competition.
11.4 Nothing in these Terms limits, excludes or modifies any rights or guarantees which cannot lawfully be excluded, including under the Australian Consumer Law.
11.5 To the maximum extent permitted by law, the Promoter's liability to any Entrant in connection with this Competition is limited to the value of the Prize that Entrant would have been entitled to receive.
11.6 The Promoter is not responsible for any loss, damage or injury suffered by an Entrant or a Nominated Child in connection with participation in this Competition or receipt of a Prize.
11.7 This Competition is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook, Meta or any other social media platform through which entries may be submitted.
11.8 Entrants releasing Entry Content via a social media platform remain responsible for complying with that platform's terms of use.
12. Governing Law
12.1 This Competition and these Terms and Conditions are governed by the laws of the State of Victoria, Australia.
12.2 By entering the Competition, Entrants submit to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia.
